Good Faith in Contract and Property Law
Good Faith in Contract and Property Law Good faith is already a familiar concept in international commercial law and a recognized principle of substantive law in several major legal systems. In the United Kingdom, however, a role for good faith and, more fundamentally, the issue of whether or not there ought to be a general principle of good faith informing English and Scots contract and property law, are still matters for debate. This book covers the debate, containing papers delivered at the Symposium on Good Faith in Contract and Property Law held at Aberdeen University in October 1998. While its central core reflects on good faith from the perspective of a mixed legal system (Scots Law), papers on good faith from an English and European perspective locate the debate within a broader jurisdictional context.

Resolved Question: What's the name of this movie?
I just need the title name. Hopefully someone knows this movie. It's about a lowly young woman (from a farming family whose father and mother are both poor (I believe they are from Scotland) and the mother was dying from a disease) whose name I forget, but she started out as a maid and worked in a wealthy family house, she fell in love with one of the boys and had sex in a cave (lol) and got pregnant. Ever since then, she moved and worked in several clothing/sowing shops and had her baby then, it was a girl. She kept the baby as illegitimate. She received several amounts of aid and such from many men, including this one Jewish man. She also worked in a factory with sowing machines. I believe that one day she was walking down the street and encountered a Jewish man being stoned by a few rascals/kids, and she told them to stop and they ran away. She then asked the man why they were throwing rocks at him. She did not understand what it meant to be in a position of a Jewish during that time (it was around the late 1920s to 30s; the girl's parents were born in the late 1800s). He invited her to their family dinner. She brought in something that Jewish do not eat, and she was confused, lol. It was soon found out that the father runs a sowing business and she was invited to design some clothes... Eventually as the years passed by, she wanted revenge against the man who impregnate her and left her and did not support her at all. She got this revenge by basically buying out all of the valuable properties that the man wanted for his business, they would have never thought that a woman bought it. Soon, it came to a point where she bought out his entire property and he was left with nothing. She married many times, but her marriages failed due to her busy work and neglecting behaviour towards to her spouse and children. One man did stayed for the longest time but eventually did not wanted to stay any longer. Her business grew larger and larger. Her best friend was the Jewish man's son, who she did had some romance interest, but he was Jewish and would marry a Jew, I think. She first started her business as a small jelly shop, eventually moving up to fashion, jewelery, perfume, such and such. Eventually, it was the 1970s. Her birthday was coming soon and she is going to retire and eventually passing down all of the money to her family. Her sons were conspiring against her to take all of her money away, she discovered this, and she made a plan right away. Told her assistant to sell everything she owns and liquefied everything into hard solid cash. In the end, when she made the announcement to whom she'll pass down her inheritance was her granddaughter (I forgot her name, but she was blond) and her sons and daughters were outraged. She told everyone the reason why, because everyone else in the family are corrupted except the granddaughter. That they were just waiting for her to die and pass the money down to irresponsible hands. She gave 90% of the money to the granddaughter, and 1 million dollars to everyone else. This movie was friggin ass long, but I watched it until the end. I just don't remember the title and I really want to watch it again!! PLEASE AND THANK YOU! I pray that someone knows the title to this movie!! I believe it was a 70s to early 80s movie...!! :) Jurassic Park and Finding Nemo???? WTH D: .... Serious answers please!! =\ (more...)

Resolved Question: Can you help me with with my sugar substitute?
I AM SCOTTISH AND LIVE IN SCOTLAND, UK. I'm happy and proud to say that I am a slim, 24 year old woman, therefore I don't need to worry about losing weight. However, I wish very much to MAINTAIN my weight as it is now and, you never know, lose just a TINY bit more weight, but not too much. But I digress... I've always known that sugar can be fattening for you, but only recently I learned just how much fat sugar can really put into the human body. Lately, I've been concerned about my sugar intake because I have 2 teaspoons of sugar in each coffee and tea I drink and I like to have two coffees every morning and two teas ever afternoon. Therefore, I'm having over EIGHT teaspoons of sugar a day, in addition to the sugar on my cereal. This REALLY ALARMED me and I have been thinking of ways to cut down on my sugar intake by subsituting my sugar for healthier alternatives. Here are my ideas so far. I love Sultanas, so I could use them on my bowl of cereal instead of sugar. As for my tea and coffee, I love honey, so I was thinking that I could use honey as a natural sweetener, since I've heard honey is less fattening and has many health properties. If not honey, then I could try one of those sweeteners like a Hermeseta. I have two questions. Are my substitute choices for sugar good choices, healthier and less fattening? Can you suggest anything else I can use to substitute for sugar that is healthier and less fattening? Thank you. (more...)

Resolved Question: In Scot's Law does a 'site' count as 'property/land'?
Studying Business Law in Scot's Law. I have a scenario where a 'site' is being sold. Here's an excerpt so you know the context: "John Young is director of "X". He has identified a potential development site in Lanrkshire. He enters into negotiations for the sale of the site with the present owner ..." For the purpose of the question I need to know if Property Law applies to this situation. So does a "site" count as Land? Here's what the Requirements of Writing (Scotland) Act 1995 says: (7) In this section ?interest in land? means any estate, interest or right in or over land, including any right to occupy or to use land or to restrict the occupation or use of land, but does not include? (a)a tenancy; (b)a right to occupy or use land; or (c)a right to restrict the occupation or use of land if the tenancy or right is not granted for more than one year, unless the tenancy or right is for a recurring period or recurring periods and there is a gap of more than one year between the beginning of the first, and the end of the last, such period. (8)For the purposes of subsection (7) above ?land? does not include? (a)growing crops; or (b)a moveable building or other moveable structure. So am I right in thinking a 'site' is property? Apologies if this comes across as a stupid question but a lot rides on this one technicality for my essay. Many thanks. (more...)

Resolved Question: Can someone please help me with this dilemma?
I own my home and my husband and I have worked hard to make it comfortable. We got professional builders in to create a walled garden, large patio and garden paths - they did a great job. The field bordering our garden belongs to the Church of Scotland, they leased it to a farmer who became ill and no longer farms this ground. The ground is neglected with poor drainage, therefore we have torrents of water pouring into our garden from the field. We have contacted the Head Office for the Church of Scotland on various occasions, detailing the damage caused, ie our garden walls are crumbling, our patio and path slabs are now loose and uneven and our fences are rotting away. We have also sent them photos of the floods caused by the water pouring in from their ground. Their reply has been either 'well, go into the field yourself and dig a trench to stop the water from coming into your property' or 'low lying areas are required to take the water from land next to them'. Surely this is not the case when they have neglected their ground. They have also said it is not their problem as they lease the ground to a farmer - we can't get in touch with the farmer, though. Where do I go from here? Should I contact my Buildings Insurance firm (Scottish Law) or take legal advice? Also who do you think is liable - the Church or the farmer? Should I give up on this? Resolved Question: Should I move to Scotland?
My husband and I are considering a major move, from Yorkshire to Scotland. We currently live around half an hour away from most of our family and friends, but do have family up there. Our quality of life here is pretty crummy, but we would be able to get a property with a much lower mortgage, and pay off our bills with the sale of this house. Considering somewhere in Ayrshire but can you recommend anywhere else? Has anyone who moved from England to Scotland experienced any antagonism towards them because of their nationality? OR, if you are Scottish, how do you feel about the English moving in next door? Thanks (more...)
