Open Question: How long does it take for a short sale to come back and tell me if my offer was accepted in NY?
How long does it take when the property is a short sale? The owner approved the offer, but what about the bank? How long does it take? I'm trying to get an estimate. Thanks Well it makes sense that the banks should accept any offer because once it goes into foreclosure, they might even have to lower the price even more? So I don't understand what the bank has to gain/lose..it's on the road to foreclosure anyway!! (more...)

Open Question: Capital Loss on House Sale?
Publication 544 from the IRS specifies that losses from personal use property (such as houses and cars) cannot be deducted as a capital loss, but I cannot find the specific section in the Tax Code (http://www.law.cornell.edu/uscode/html/uscode26/usc_sup_01_26.html) that addresses this. When we sell the enitre property, what will be my basis for the capital gains... the value of the property when I inherited it, the value of the property when it was placed in the LLC, or the amount the LLC "purchased" the deed from me? Open Question: Cancelling House Sale agreement?
Hello, Recently I have signed a sale agreement with a builder for 5 Lacs. They have taken the responsibilty for getting home loan for the balance amount. and promised us that the house will be built according to our wish. We have told them that if the bank loan is not sanctioned for the balance amount we will not be able to buy the property from them (But all these are verbal no written statements). Now it looks we wont get the bank loan for the balance amount and the builder is not willing to bulit the house as per our wish.There is no clause in the agreement for any refunds or no notes for cancellation policy. In this case the builder says he spent some money for getting hosue plans approved so he wont refund the money. What is our situation now? How can we get our money back? (more...)

Open Question: Can a housing developer legally film my 8yr girl playing on our drive and put it on net without our permission?
we live on a new housing development by RedRow homes, we've been here since summer 2007. On that summer a film crew was out and about filming properties in the area, i recon they were hired by redrow for some sort of sale promotion for the rest of the houses that were still for sale in the cul-de-sac. It wasn't till the other day i was on youtube, i typed in my town name, like you do, and the search results showed the usual stuff, then i saw a video posted by Redreow, it showed my street name, i clicked on to it and there it was a street scene promotional viedo they were filming back in 07, then, towards the end to my amazement it clearly showed my 8yr old daughter coming up our private drive on her scooter,the film crew were right outside our house, i wasn't aware at the time, i know if she was in a public area she has know choice about been filmed, people are filmed every day, not on there own property though. I'm not sure how i feel about this, first no one from redrow has asked our permission to film, and second i'm a little anoyed about it appearing all over the internet,it's on there own web site, i understand the need to promote there propertys but putting it on Youtube is going a bit too far, you get alot of undesirables on these sites and thinking my daughters on their for all to see makes me uncomfotable. What shall i do, do i forget about it or what, i feel like our privacey has been exploited. advice welcomed (more...)

Open Question: What's the best way to get information on probate/estate properties for sale?

Open Question: Has anyone experienced living in a rental that's for sale to a new owner?
Our landlord passed away and his family is selling all his properties. The real estate agent has just viewed our 3 apartments and is putting the building up for sale now. My neighbors and I are very nervous about all this. We really don't like the idea of all sorts of strangers entering our homes for who knows how long. It could take forever to sell anything with the economy like it is. We are in NJ and we do know that a 24 - 48 hour notice is required before bringing prospective buyers into our homes... but still... I know that my neighbors are very nice and clean and take care of things like I do. I'm sure that they noticed during the visual inspection. We even keep the yard nice. I'm just praying that the building will be sold with tenants included. I just dread having to move again, since I just got settled in. Any thoughts or ideas from those who went thru the same ordeal?
